EU member states have an obligation to monitor for the possible presence of toxin producing plankton in shellfish production and relaying areas, and for biotoxins in live bivalve molluscs.
The monitoring programme for algal biotoxins is a requirement of the Council Directive of 91/492/EEC of 15 July 1991, laying down the health conditions for the production and the placing on the market of live bivalve molluscs which is implemented in England and Wales by the Food Safety (Fishery Products and Live Shellfish) (Hygiene) Regulations 1998 as amended.
The Food Standards Agency, as the competent authority, has overall responsibility for ensuring that this monitoring programme is effectively carried out.
