Publication of implementing and transitional legislation in the EU Official Journal - 25 October 2007

Following negotiations since October 2006, reports of which have been published on the web site, the latest EU implementing and transitional regulations to the food hygiene legislation have now been published in the EU Official Journal (OJ) on 25 October 2007. The regulations apply 20 days after OJ publication (13 November 2007).

The newly published regulations

Regulation (EC) 1243/2007 – amends Annex III of Regulation (EC) 853/2004 and provides for (i) a derogation for vessels engaged in small-scale coastal fishing from some record keeping and (ii) the addition of two further methods of gelatine production, changed requirements for wrapping and packaging gelatine as well as other minor changes to the legislation that will provide clarity of interpretation.

Regulation (EC) 1244/2007 – amends Regulation (EC) 2074/2005 and (i) permits an alternative screening method for Amnesic Shellfish Poisoning (ASP); (ii) describes the requirements regarding veterinary attendance during post-mortem inspection in some circumstances and (iii) sets the criteria for the ‘visual only‘ inspection of young animals.

Regulation (EC) 1245/2007 – amends Annex I of Regulation (EC) 2075/2005 and provides for the use of liquid pepsin for the detection of Trichinella in meat.

Regulation (EC) 1246/2007 – amends Regulation (EC) 2076/2005 and extends the periods of derogations of imports of fish oil from third countries.

One regulation amending the microbiological criteria regulation (considered by SCoFCAH on 16 October 2007) is still in the pipeline.
