Concerning the consultation issued on 15 August 2008, on The Natural Mineral Water, Spring Water and Bottled Drinking Water Regulations Scotland (Amendment) Draft Regulations 2008, FSA Scotland would like to clarify that changes to the derogation date for tankering spring water in Schedule 4, paragraph 5(3) from 23 November 1996 to 13 December 1996.

Consultation details

This was due to the European Commission’s decision on the date of this derogation in Annex II of the Directive. Note that specific dates for this derogation do not appear in the most recent full draft Directive enclosed with the previous letter, but their addition was agreed after this was produced and will appear in the published Directive. The closing date for comments on the consultation is the 26 September 2008.

The final consolidated Directive is expected to be published in October. There will not be time to consult on a new Statutory Instrument before the new Directive comes into force. The Agency is therefore consulting on a draft Statutory Instrument, based on the current draft consolidated Directive. It is not expected that this Directive will change significantly before its publication.

Similar legislation will apply in England, Wales and Northern Ireland. The amending legislation will not result in any substantive changes; therefore the Agency does not intend to produce an Impact Assessment.

If, however, you believe that this new SSI will result in a significant change, requiring an Impact Assessment, we would welcome your comments and supporting evidence by 26 September 2008.

This consultation has been prepared in accordance with the (External) HM Government Code of Practice on Consultation , which states that a consultation must follow better regulation best practice, including carrying out an Impact Assessment (Regulatory Impact Assessment in Scotland). The assessment is included in the consultation documents.
